Notice of UCC Article 9 Foreclosure Auction of Collateral (Restaurant Equipment and related assets)

Please take notice that Howard McLure, an individual (the “Secured Party”) is the holder of that certain Promissory Note, dated July 1, 2022 (the “Promissory Note”) issued pursuant to that certain Security Agreement dated as of July 1, 2022 entered into by Second Street Restaurant, LLC, a Florida limited liability company (“Borrower”) in favor of the Secured Party (the “Security Agreement”).

The Secured Party’s security interest in the Collateral described in the Security Agreement was perfected upon the filing of a State of Florida Uniform Commercial Code Financing Statement with the Florida Secured Transaction Registry on August 4, 2022 (the “Financing Statement”). Based on records with the Florida Secured Transaction Registry, Corporation Service Company, as Representative, filed a State of Florida Uniform Commercial Code Financing Statement dated September 20, 2023, thereby perfecting a security interest in Borrower’s property that is inferior to Secured Party’s security interest in that property under the Security Agreement and Financing Statement.

The Borrower is in default of its obligations under the Promissory Note and the Security Agreement.

The Secured Party intends to sell all Collateral to Be Sold in a single lot but reserves the right to sell the Collateral to Be Sold in multiple lots, by way of one or more contracts, and on such terms and conditions as are agreed upon between the Secured Party and any purchaser of the Collateral to Be Sold.
